Terms and Conditions
These Terms and Conditions explain the rules for using UZIMAPLAN, including account use, subscriptions, payments, health-planning information, and user responsibilities.
1. Acceptance of Terms
By creating an account, signing in, subscribing, or using UZIMAPLAN, you agree to these Terms and Conditions and to the UZIMAPLAN Privacy Statement. If you do not agree, you should not use the app.
2. About UZIMAPLAN
UZIMAPLAN is a personal health-planning application that helps users record selected profile, activity, waist-risk, nutrition, tracker, and subscription information. The app provides general planning support and calculated indicators such as BMI, BMR, TDEE, waist-to-height ratio, heart points, and menu guidance.
3. Not Medical Advice
UZIMAPLAN is not a hospital, clinic, medical device, emergency service, diagnosis service, or treatment service. Information in the app is provided for general health planning only. You should consult a qualified health professional before making medical decisions, starting major diet or exercise changes, or relying on app results for health conditions.
4. User Accounts
UZIMAPLAN is intended for adults. You must be at least 18 years old to create an account, subscribe, or use the app. By creating an account, you confirm that you are 18 years or older.
- You must provide accurate account and profile information where required.
- You are responsible for keeping your sign-in details confidential.
- You should not share your account with another person or use another person’s account without permission.
- You should update information such as weight, height, activity, and tracker entries when it changes so app guidance remains useful.
5. Subscriptions and Access
Some UZIMAPLAN features require an active subscription. Subscription access may include features such as My Dashboard, My Plan, My Tracker, My Food Global, weekly menu guidance, and heart points.
- A 90-day plan gives access for 90 days from successful payment confirmation.
- A yearly plan gives access for 365 days from successful payment confirmation.
- Where a subscription is renewed before expiry, the new access period may be added from the existing expiry date.
- UZIMAPLAN may provide a grace period after expiry, but access after expiry is not guaranteed unless a valid subscription is renewed.
6. Payments
Payments may be processed through M-Pesa or another payment provider. Subscription access is activated after successful payment confirmation. Payment provider delays, failed prompts, incorrect phone numbers, network failures, or declined payments may delay or prevent activation.
UZIMAPLAN may store payment confirmation details such as amount, receipt number, plan, subscription status, payment phone number, and transaction identifiers needed to manage access, support, reconciliation, and receipts.
7. Refunds and Billing Support
If you believe a payment was made in error, duplicated, or not reflected in your account, contact support@uzimaplan.com with your account email, M-Pesa receipt number, payment date, and phone number used. Refunds or corrections will be reviewed based on available payment records, service access status, and applicable requirements.
8. Food and Nutrition Information
My Food Global provides general nutrition information and menu guidance for planning purposes. Food composition can vary by brand, preparation method, portion size, recipe, soil, season, and source. Users remain responsible for judging suitability, allergies, medical restrictions, cultural preferences, and professional dietary advice.
9. Acceptable Use
- Do not use UZIMAPLAN for unlawful, harmful, abusive, fraudulent, or misleading activity.
- Do not attempt to interfere with the app, payment process, database, authentication, or security controls.
- Do not upload, enter, or transmit content that infringes rights, violates privacy, or harms another person.
- Do not copy, reverse engineer, resell, or misuse the app or its content except where expressly allowed by law or written permission.
10. Availability and Changes
We aim to keep UZIMAPLAN available and reliable, but access may be interrupted by maintenance, updates, hosting issues, network failures, payment-provider outages, or events outside our control. We may update features, prices, plans, content, and these Terms from time to time.
11. Intellectual Property
UZIMAPLAN branding, app design, content, data structure, software, and related materials are owned by or licensed to the UZIMAPLAN operator unless otherwise stated. You may use the app for your personal account purposes, but you may not reproduce, distribute, sell, or exploit the app materials without permission.
12. Privacy and Data Protection
Your use of UZIMAPLAN is also governed by the UZIMAPLAN Privacy Statement. The app handles personal and health-related information, and users should read the Privacy Statement carefully before creating an account.
13. Limitation of Liability
To the fullest extent permitted by law, UZIMAPLAN is provided on an “as is” and “as available” basis. We do not guarantee that the app will be uninterrupted, error-free, or suitable for every personal health situation. We are not liable for decisions made solely from app information, payment-provider failures, user-entered errors, or indirect losses arising from use of the app.
14. Suspension or Termination
We may suspend or restrict access where necessary to protect users, investigate suspected misuse, manage unpaid or expired subscriptions, comply with law, or maintain app security and reliability.
15. Governing Law
These Terms are intended to be governed by the laws of Kenya, unless another mandatory law applies. Any dispute should first be raised through support@uzimaplan.com so that it can be reviewed and resolved where possible.
